Chief chinedu also thank the people of plateau state for their prayers for the rescue administration and thank the plateau State government for finding him worthy for the construction of sabon gari mado road which was already given to him and promise to complete it on time and do a quality work as he has already started, and he call on the sabon gari community that the raining season is coming to an end they will soon start most of the earth work, as such was not done just because of the raining season.

E D Pwajok (SAN) one of the team leader to the petitioners, in an interview with journalist after the out come of the judgement said so far they have spotted some grounds of appeal, and even the tribunal found out that the 2nd respondent gave false information in form CF001, which is clearly stated and with this they have already formulate many grounds of appeal, and some of the findings of the tribunal is not in sink with the conclusion that the read, and the Supreme Court judgement was also not use, it may be as a result of logistics problem, but however they remain confident, according to him the celebration has just been shifted but they will retrieve the mandate at the appeal or the Supreme Court.

Following the judgement of the Governorship Election Petition Tribunal in Jos on Wednesday, October 2, 2019, the PDP Plateau Governorship Candidate Senator (Lt. Gen) Jeremiah Timbut Useni has been fully briefed by his Legal Team on the outcome of his petition.
He has expressed his appreciation to his legal experts and said he maintains his confidence in them.
He has also expressed confidence in the Nigerian judiciary to do substantial justice.
Consequently, General Useni is convinced that there are many grounds to appeal the judgement. He has therefore instructed the legal team to take all processes with immediate effect and proceed on appeal against today’s judgement.
Gen. Useni is further encouraged by the fact that the Supreme Court had last week upheld his interlocutory appeal against a Court of Appeal judgement which expunged the testimonies of 21 of his witnesses earlier considered by the tribunal. Unfortunately, the tribunal did not avert its mind to the Supreme Court judgement which in turn affected today’s judgement.
In addition, the bulk of the tribunal’s findings are in fact in favour of his petition, for example, the fact that Governor Simon Bako Lalong did indeed give false information on oath. But surprisingly, the tribunal did not give any consequential order to nullify his election.
Gen Useni appeals for calm among supporters and party faithful, and assures that he will resolutely deploy legal instruments to retrieve the mandate that the people of Plateau freely gave him in the polls.
He appeals to the people to keep hope alive.

the Action Democratic Party Plateau state having been following activities at the election tribunal in the state wishes to inform the public that we do not have any intention of joining issues over the verdict declared by the tribunal because we as a party are not in anyway a party to the case at the tribunal and do not wish to undermine the effort of those who took their case to the tribunal but wish to at this point as ever before congratulate the acclaimed winner, His. Excellency Barr. Simon Bako Lalong over his victory at the poll and the tribunal.
ADP in Plateau state is more determined than ever before to serve as the third eye in making sure nothing but the best in governance is giving to the peace and good people of our dear state.
Therefore we call on the governor to as a matter of urgency settle down and remain in the state so as to address major areas of governance the state needed at this time.
Our city and urban roads need urgent attention, this is apart from the security challenges that has Continue to bedeviled the state by resurfacing almost on daily basis. The need for true reconciliations among the good people of the state.
The government should also intensified efforts in resettling displaced citizens of the state and provide adequate security for them.
ADP is also calling on the government to work hard in the area of education by making sure that our schools in the state are made comfortable for learning and ensure adequate provision of the school materials to all institutions of learning, ADP in Plateau state is also calling on the government to quickly look into addressing all the lapses in the healthcare sector.
We want to assure citizens that our great party will not compromise for anything in ensuring that Plateau is considered first by the present administration and urged every party loyalist to remain calm as we all join hands in making our state the envy of all.
Finally we are calling on the governor of the State Simon Bako Lalong to fulfilled his promises of all inclusive government to take the state to greater high .

LALONG FLOORED USENI AT THE TRIBUNAL.

Plateau Guber Tribunal Judgment: Panel holds that the false information made in form CF001 by Lalong is not fundamental in nature.

  • The issue of lalong different names as allege by the petitioners and the certificate issue the tribunal held that the petitioners did not plead and says lalong the second respondent is not the owner of the certificate, and the tribunal held and resolved that the second respondent lalong is the owner of the certificate and all the 4 different names are link together and as such, and the electoral acts Show’s and said to contest for an elections you most have up to secondary results that’s the minimum qualication, and the second respondent has the qualication and he’s therefore qualify to contest for an election.The tribunal resolve the issue in favour of the second respondent lalong.

The tribunal also holds that pw1,8,9,6,5,2 after adopting their witness on oath also couldn’t prove over voting, the petitioners present 71 witnesses and tendered over a hundred documents, the tribunal rule that pw71 who identified the documents as inec documents as the 1st respondent and the petitioners haven’t listed over 300 areas and front loaded over 300 witnesses deposition only presented 71 witnesses and was able to prove 13 polling units for over voting and cancellelations.

Total votes APC in March 595,582. PDP 546,813, nullified votes by tribunal
APC 4065. PDP 1,439,

total votes after judgment Apc591,572 PDP 545,374Total winning votes 46,143. Tribunal said with just 13 polling proved out 38 witnesses called by PDP.

The petition was able to prove 4,35 votes when added together as against 591,517 of APC and PDP 545,374 and the difference is 46,143 over the above petition, so on the ground of this the petitioners couldn’t prove their petition and here by the tribunal found no merit on it and dismiss the petition.

HOPE*

Greetings to my fellow country men and women.

I rejoice with you as we mark our independence day.

This day is significant because it reminds us that yes, indeed we are free from the control of another nation. But it also represents our common aspiration to build a state that promotes our shared values of mutual respect, unity, justice, security and to practice a democracy that upholds the choices of the people and cares for their welfare.

So, at 59, we look back and acknowledge that we are not yet where we should be, but we are also not where we started. We have much ground to cover in the years ahead.

Therefore, let us keep hope alive. Let the hope of a better, more prosperous, much greater and truly united Nigeria inspire us to offer ourselves for selfless service, share with the needy and seek justice that works for all.

The Supreme Court grants PDP prayers to fill in additional witnesses at the tribunal

*Gen. Senator Jeremiah Timbut Useni And PDP Wins Big Against Lalong And APC At The Supreme Court*

The Supreme Court of Nigeria in a full court this morning granted the prayers of the Legal Team for PDP and it’s Governorship candidate in the 2019 general elections, Gen. Senator Jeremiah Useni.

Hon. Justice Bode Rhodes-Vivour, delivered the lead judgment, has also ordered that the said judgement should be serve to the 3 man tribunal.

The Legal Team had challenged the judgment of the Court of Appeal Jos which overruled the decision of the lower Tribunal allowing Petitioners witnesses who were not listed in the Petition to testify during the trial.

The Supreme Court also dismissed the preliminary objections raised by Lalong and APC.

This judgment is to be served on the 3-man Tribunal before they deliver their final judgment on or before the 9th of October, 2019.

The National and State Assembly Election Petition Tribunal sitting in Jos has confirms the election of Hon. Baba Hassan of the All Progressive Congress ( APC), as member representing Jos North/North in the Plateau state House of Assembly and also in like manner dismissed the petition of Barr. Manir Abdullahi Barau of the Peoples Democratic Party ( PDP).
The election of state Assemblies election was conducted on the 9th of March, 2019, and declared and returned Hon. Hassan as the duly elected member Jos North/ North, Plateau state House of Assembly having fulfilled all the conditions required INEC and issues him with the certificate of return, into the office.
However,the candidates and the people Democratic Party not satisfied with the decision of INEC, who is the 1st respondent,PDP Petitioners approached the tribunal asking it to set aside the decision of the 1st respondent INEC
The summary of the grounds of the petition was that at the time of the election, Hassan ( who was the 2nd respondent) was not qualified to contest for the election as he allegedly submitted to INEC an affidavit in form CF001, containing false information as he allegedly submitted a forged Diploma Certificate from the University of Jos before the 2015 election. the petitioners prayed that the declaration and the affidavit contained false information, that the 2nd respondent was not qualified to contest for the election in 2019 as result of false information given to the 1st respondent; An Order nullifying the election and declaration of the 2nd respondent as the winner of the election into the House of Assembly Jos North/North state constituency conducted by the 1st respondent and withdrew the Certificate of Returned given to the 2nd respondent by the 1st respondent; An Order compelling the 1st respondent to conduct fresh re- run election and, an Order to stop the 2nd respondent from participating in the re- run.
The 2nd respondent in his response however, submitted that the petitioners were not entitled to the reliefs sought and urged the tribunal to dismiss the petition.
During hearing, the petitioners called 4 witnesses and presented 12 exhibits; the 2nd respondent called 3 witnesses and presented 17 exhibits while the 1st respondent did not call any witness nor presented any evidence. Likewise the 3rd respondent ( APC).
After exchange of processes, Counsels for the petitioners and the respondents finally adopted their Final Written Addresses on 2 September, 2019.
In its judgment on Monday, the tribunal expunged several exhibits and paragraphs in the petitioners’ replies to replies to both 2nd and 3rd respondents replies to the petitioners petition.
Further more, the tribunal held that going by section 135 of the penal code, forgery is a criminal offence. However, the tribunal held that though the petitioners claimed that the 2nd respondent presented forged Diploma Certificate from the University of Jos, to the 1st respondent could not proved beyond reasonable doubt how the said certificate was forged. More so that the 1st respondent, who is the electoral umpire maintained that the 2nd respondent fulfilled all the requirement set out by it as prerequisite qualification for the contest. Adding that Also, the investigation conducted by the Nigerian Police on the issue of the Certificate forgery exonerated the 2nd respondent from that act as the Police officer who investigated the 2nd respondent Inspector Sunday Baba testified before the tribunal that at the end of the Police investigation, the 2nd respondent was not found culpable of Certificate forgery.
The tribunal also faulted the petitioners for not presenting before it, series of documents relating to the alleged forgery and could also not call some personalities to clarify some knotty issues regarding their allegation. For instance, the tribunal wondered why the petitioners failed to called Barr. Dandam, the former Registrar of the University of Jos who through exhibit 9 confirmed that the 2nd respondent did attend, graduated and was conferred with a Diploma Certificate in Business Administration.
The tribunal further held that most importantly, the petitioner having alleged Certificate forgery by the 2nd respondent, ought to have presented before the tribunal, the original copy of the alleged forged Certificate for comparison which they also failed to do.
In the light of the above, the tribunal ruled the 2 issues raised in the petition in favour of the 2nd respondent and against the petitioners. The tribunal further held that the 2nd respondent did not lie on oath. In all, the tribunal held that the petitioners did not prove their case beyond reasonable doubt and dismissed same for lacking in merit
